terms & conditions

By enrolling onto a participation class at The Workshop under The Garage Trust (“The Workshop”, “Workshop”, “The Trust”, “Trust”), you accept these terms and conditions (“Terms & Conditions”) as an ongoing agreement between you and The Trust (“Agreement”).

The Agreement is made between the participant (“Participant”), or parent/guardian when the participant is under 18 (“Parent”) and is valid at all times whilst the Participant is engaged in any Trust and until such time as written notice is given in accordance with these Terms & Conditions.

1 Introduction

1.1 These Terms & Conditions apply to all classes, courses, workshops, holiday workshops, and any additional activities and/or services offered by The Trust (“Trust Activities”) in the future for any Participant

1.2 In order to partake in any Trust Activities all Participants/Parents are required to consent to these Terms & Conditions by signature or by ticking the acceptance box for these Terms & Conditions when submitting an electronic application form online. We may update these Terms & Conditions from time to time.

1.3 Any changes to these Terms & Conditions require the written consent or approval of The Garage Trust.

1.4 A “Class” refers to a programme of classes offering tuition in dance, drama and/or other performing arts related activities delivered over 36 weeks of the Academic Year.

1.5 A “Course” refers to an educational qualification, such as GCSE Dance or Drama, which is delivered during the Term (including online activities). Course classes will take place once per week for a certain number of hours, as detailed at the time of booking.

1.6 “Term” refers to one normal academic term of during which Courses are run.

1.7 “Term Dates” refers to the dates for the relevant Term. Specific Term Dates can be found on The Workshop website.

1.8 “Academic Year” refers to the period 01 August – 31 July. Each academic year comprises three terms:

  • Autumn term: September – December
  • Spring term: January – Easter
  • Summer term: Easter – July
 

1.9 “Workshop” refers to a one-off course (including online activities) offering tuition in dance, drama, singing and/or other performing arts related activities which will be delivered for a period as specified at the point of booking and can run at any time throughout the year. These may be run at any point during the Academic Year, and not exclusively held within Term Dates

1.10 “Online” refers to online streamed lessons and Workshops

2 ENROLLING A NEW PARTICIPANT

2.1 Each Participant’s place is allocated on a ‘first come, first served’ basis. Registrations must be accompanied by the appropriate initial payment (“Deposit”).

2.2 The Deposit for registration is equivalent to two months’ instalment payments at the full academic year price from September, relative to class type. For Theatre Company there is an initial “Deposit” payment of £85.00 and 7 months of £85.00 from 1 October 2025 – 1 April 2026.

2.3 The Deposit for all other activities may vary depending on the nature and length of the activity

2.4 If the Participant’s desired class is at capacity, The Trust will operate a waiting list and endeavour to introduce a second class. No Deposit payment is required while the Participant is on a waiting list.

2.5 From the date the Deposit is paid, you have a fourteen (14) calendar day cancellation period (“Cancellation Period”) to change your mind and cancel the Participant’s place in the chosen class.

2.6 After the Cancellation Period expires, the Deposit is non-refundable and will be retained by The Trust.

2.7 Times, current Term Dates, fees and all relevant course details will be confirmed at the point of booking.

3 PAYMENTS

3.1 For a Participant enrolled on a Class, the fees will be taken by recurring card payments as equal monthly instalments, as specified at the point of booking.

3.2 For a Participant enrolled on a Course, following payment of the Deposit, the remaining fees will be taken by recurring card payments as equal monthly instalments, as specified in the Confirmation Letter. Fees must be paid in full prior to the final examination.

3.3 Any Balance Payment must be paid in full, subject to any alternative agreements made with The Trust’s Executive Director or Business Manager, prior to the start of the activity.

3.4 Instalment payments may be made in cash but these transactions must be tendered prior to the due date of the next card payment, in order to override the automatic payment. It is the responsibility of the Participant to make the payment. The Trust will not be able to refund any automatic card payment taken in place of a missed cash transaction.

3.5 Transaction charges apply to cheques of £1 per cheque.

3.6 In the event of a missed payment, but the Participant still attends classes, a £30 + VAT administration fee, plus the cost of the individual classes attended in the interim period, will be charged.

3.7 In the event that the card held on file by The Trust is due to expire, the Participant or Parent will receive an email notification. It is the Participant/Parent’s responsibility to inform the Trust of any changes to card details. Payment failure due to an expired card will be subject to the administration fee for missed payment as specified in section 3.6 above.

3.8 In the event of non-payment, The Garage Trust may take legal action to obtain the outstanding balance.

4 CLASSES

4.1 The Trust commits to providing a minimum of 33 contact sessions per academic year, as per each Class’s regular schedule.

4.2 In total, The Trust plans to deliver at least 36 contact sessions throughout the year.

4.3 Contact Sessions are defined as, but limited to, additional rehearsals, external events, performances and showcases, in addition to weekly class sessions.

4.4 The length of the contact session is relative to the class type’s regular duration, defined as follows:

  • Theatre Company: 1.5 hours

4.5 If a Contact Session is missed because The Garage Trust are unable to deliver the session then this will not usually count towards the minimum number of sessions.

4.6 If a Contact Session is missed for any other reason beyond the control of The Garage Trust, including the Participant’s absence due to illness or a personal event commitment, then the session will count towards your minimum lesson quota.

4.7 Where Classes have been disrupted for any reason, even if they do not fall below the minimum quota, The Garage Trust may, at its discretion, deliver additional “catch-up” sessions. To provide a seamless learning experience to the Participant, these may be taught by a different tutor to the usual Class leader.

4.8 If The Trust fails to deliver the minimum quota after making reasonable efforts to do so through the means above, The Trust may choose to offer credit on account or a refund.

4.9 If a Course session falls on a Bank Holiday then a replacement class will also be added onto the end of the current Term timetable or the subsequent Term. This date will be confirmed by The Garage in advance of the Bank Holiday.

4.10 Participants are automatically re-enrolled into the Course for the following academic year.

4.11 If the Participant wishes to cancel you must notify The Garage Trust in writing to info@theworkshop.org.uk with at least four weeks’ notice. Cancellations will be applied effective at the end of Autumn Term, Spring Term or Summer Term.

5 WORKSHOPS

5.1 Dates and times of Workshops are released a minimum of half a term in advance of the activity.

5.2 For the avoidance of doubt, the Taster sessions are not available for and do not apply to Workshops.

5.3 If you cancel a place on a Workshop outside of the Cancellation Period and within fourteen (14) calendar days of the commencement of the Workshop, you will be required to pay fifty percent (50%) of the fees for the Workshop

5.4 If you cancel a Student’s place on a Workshop outside of the Cancellation Period and within seven (7) calendar days before the commencement of the Workshop, you will be required to pay the full fee.

6 COURSES

6.1 At the point of registration for an Accredited Course the Participant or Parent agrees to pay the full fee for the Course. Fees for admission onto Accredited Courses cannot be refunded if the Participant chooses to no longer attend.

6.2 If it is no longer possible for the Participant to attend, requests for extraordinary refunds  may be made in writing to the Executive Director c/o info@theworkshop.org.uk If any refund is issued in this circumstances it will be pro-rated to account for the Course sessions that have already been delivered, less an administration fee of £150 + VAT.

7 USE OF PERSONAL INFORMATION

7.1 The personal data (as it is defined in the Data Protection Act 2018) of a Participant and/or Parent will be processed by The Garage Trust, in accordance with its Privacy Policy, which can be found at https://www.thegarage.org.uk/privacy-policy/.  A hard copy of the Privacy Policy can be requested from marketing@thegarage.org.uk.

7.2 Any intellectual property created during any Class, Course, or Workshop is owned by The Garage Trust.

8 MEDIA CONSENT

8.1 During a Contact Session the tutor or another member of The Garage team may occasionally be present to take photographs, videos, or other recordings of the session. By enrolling in any Class, Course or Workshop the Participant gives permission for these records to be made, by The Trust, for use on its website, any of its social media channels, or in any relevant press coverage.

8.2 The Workshop understands there are exceptional circumstances where the sharing of a Participant’s image is inappropriate and may cause a risk to personal safety. In these such instances, the Participant or Parent must give a valid reason in writing to info@theworkshop.org.uk as soon as possible.

9 GIFT AID

9.1 Gift Aid is a tax relief set up by the Government to enable charities to claim back 25p for every eligible £1 donation that is made to a charity.

9.2 The Garage Trust is a charity and able to claim this additional 25% on eligible donations made by UK taxpayers, which includes any Subscription fees received that allow the Participant to take part in activities that form part of the charity’s objectives

9.3 Gift Aid can be claimed by the Trust at no additional cost to the Participant/Parent

9.4 In order for The Trust to claim, the Participant must be a UK Taxpayer and have paid Income Tax and/or Capital Gains Tax for the year of donation at least equal to the tax treated as deducted from the donation.

9.5 The Trust cannot claim Gift Aid on a Subscription purchased on behalf of a Participant, unless said Subscription is purchased on behalf of a Participant under the age of 18.

9.6 Following completion of registration, The Workshop will contact Participants/Parents with a Gift Aid declaration to confirm eligibility.

9.7 If the Participant/Parent ceases to be a UK tax payer they must notify the Trust in writing to info@theworkshop.org.uk. If The Trust has not been made aware of a change in circumstances and reclaims tax from a donor who has not paid sufficient tax, it is the Donor’s responsibility to repay the funds to HMRC.

10 HEALTH AND SAFETY

10.1 Participants participate at their own risk and are obliged to inform The Trust and its staff of any existing injuries or medical condition. All application forms must have any known medical conditions stated and any changes to such information must be notified to The Trust immediately in writing to info@theworkshop.org.uk.

10.2 If you are unsure whether a Participant should participate in any activity please consult the Participant’s GP before enrolling the Participant on an Class, Course or Workshop.

10.3 Any medication brought on the premises must be clearly labelled and is the responsibility of the Participant. The Participant should be able to administer it themselves, or the Parent is required to remain present on site in the event that a dose is required.

10.4 Participants must wear suitable footwear and clothing at all times.

10.5 If a Participant is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided at the point of registration.

10.6 Participants or Parents where the Participant is under 18 are solely responsible for ensuring that the emergency contact details on The Trust’s records are up to date.

10.7 All online activities are recorded and held for a period of four weeks for safeguarding and quality review purposes. 

11 PERSONAL PROPERTY

11.1 Participants are obliged to take care of their own belongings. The Garage Trust can accept no liability for lost or damaged belongings.

11.2 The liability of The Garage Trust and that of its staff is restricted to class time only and then only to gross negligence.

12 GENERAL

12.1 The Workshop may, at its own discretion, refuse a Participant entry to an Activity or specific session of an Activity if it is felt that the Participant’s behaviour is unacceptable

12.2 The Trust reserves the right to make changes to the timetable, the teaching staff, the advertised programme or the programme delivery mechanism (for clarity this may mean that we switch to online zoom classes) in the event of illness or other circumstances beyond our control.

12.3 All Participants must be collected on time after a session. The Workshop is unable to supervise Participants after a session and consistent late collection may result in additional charges.

12.4 Fees are reviewed annually and may be increased each year.

12.5 These Terms & Conditions constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

12.6 In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.

12.7 The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.
